Effective July 1, 2006, Public Law No. 109-171 Deficit Reduction Act of 2005 Section 6036 requires individuals to provide satisfactory documentary evidence of citizenship or nationality when initially applying for Medicaid or upon a recipient's first Medicaid re-determination. Copies of the law and the Interim Final Rule that include detailed information regarding this statute and the specific documents that are recognized as satisfactory documentary evidence of citizenship and identity are contained in the Downloads section on this page. Also included in the downloads is a June 9, 2006 State Medicaid Directors' Letter which was published prior to the Interim Final Rule. Please reference the Interim Final Rule for the most current guidance.
